Protecting your child who has a physical and or mental disability and securing that future when you’re gone is one of the most important things that a parent can do. Estate planning can be challenging in any situation, but having a child or family member with special needs brings different challenges.
You may wish to consider these questions:
- What assets are required to provide for the standard of living you would desire to see them have?
- Will provincial benefits (ODSP for example) be affected by your estate plan and should this be a concern?
- Who will manage their assets and what is required to ensure that process is put in place?
- What about other siblings? Are family dynamics at all affected by the structure of a trust and is there an efficient method of achieving fairness?
